Terms & conditions

These terms and conditions form a legally binding agreement between you and us (Written Word Therapy Ltd) that governs your use of our services and this website. By registering with us and confirming that you have read these terms and conditions, you are also agreeing to be legally bound by them. It is a condition of this contract that you are:

(i) at least 18 years old;

(ii) not currently in a crisis (including a mental health crisis, suicidal, at risk to yourself or others);

(iii) capable of entering into a legally binding contract;

(iv) are legally entitled to use this UK-based service as per the laws of your own residence; and

(v) not accessing our service for research, publication or professional purposes.

OUR SERVICE

We are a England and Wales registered company and comply with the laws and regulation of this jurisdiction.

All of emails that are considered part of a therapy session are sent as encrypted files. Other emails, such as answering general questions about the service are not sent as encrypted files.

We are not a crisis service. We will endeavor to respond to emails 72 hours after the contract has commenced (the contract will commence after payment has been received and the cooling off period has either passed or been waived). You agree that you know where to find emergency help in a crisis. If you are in crisis or are experiencing suicidal thoughts, you must seek emergency help. We are not available 24 hours a day. We do not have an instant chat facility. We may not be an appropriate service for you. Either we or you may come to this conclusion and terminate the relationship by email at any time, including during initial evaluations. We will tell you in advance if we have to do this. We are not doctors, nor do we provide medical advice or medication. We cannot provide assessment or diagnoses as part of this service. If you are experiencing a medical emergency you should call the emergency services. If we are required to consult your doctor for any reason, we will obtain your consent in advance, and we may be prevented from providing our service to you if you refuse.

If you are suffering from severe mental health problems, our service may not be suitable for you. Examples of severe mental health problems include schizophrenia, bipolar disease and personality disorders. If you have suffered severe mental health problems in the past, or are not sure whether you have a severe mental health problem, or are currently taking medication for mental health problems, you should tell our therapist.

If you wish to remain anonymous and are over 18, you may do so, as long as you provide us with an email address. 

You must not send any message that is abusive or threatening. We may immediately terminate all contact with you if you do so. You must not attempt to contact us by other means than those we supply, or find out any personal details about our therapists. We may immediately terminate all contact with you if you do so. Our therapist cannot meet you in person and cannot enter into any personal or professional relationship with you other than as described on our website.

If you have a complaint about our service, you must email us within seven days of the incident giving rise to the complaint and tell us what happened and what the issue is. We do not offer refunds except as set out in the payment clause but we will endeavour to resolve issues to the satisfaction of our clients.

INFORMED CONSENT

There are many pros and cons of online therapy. Some of the advantages include easy scheduling, no travel costs and potentially being able to express yourself more easily via writing. Some potential disadvantages include lack of visual and auditory cues. We remain the owner of the therapeutic record including all transcripts, notes and emails. Posting direct information about a therapist or verbatim information from sessions is prohibited. 

ONLINE RELATIONSHIP WITH THERAPIST

In order to preserve the integrity of the therapeutic relationship, therapists are unable to accept any requests for "friendship" from online social media services such as Facebook, for business contacts, blog responses or requests for a blog contribution, or direct emails outside of sessions. Any such requests will be ignored as per guidelines from the Online Therapy Institute's Ethical Framework in order to preserve the integrity of the therapeutic relationship and protect confidentiality. 

PAYMENT

We charge for our services as follows: One session is comprised of sending one email to us, and one response from us. Your email will be limited to 2000 words. Our reply will be based on 50 minutes of the therapists time. The price is 44gdp per session (currently it is 22gdp for first time users). All payments must be made in advance via PayPal [or debit/credit card]. Subject to the following paragraph, payments are non-refundable unless we are unable to respond to you for a reason other than your breach of this contract. If we consider that our service is not appropriate for you and you have paid in advance for a session, we will refund your money in full. In order to use our services, you will need to register on our website. We will require you to input a username and an email address. You must keep these safe and not let anyone else use them. If you do any of the following things, we may terminate your account and you will not receive a refund:

(i) use the website or our Services in any way which does, or is intended to, cause annoyance, inconvenience or worry or which is abusive, threatening, fraudulent or defamatory or contains or breaches any person’s confidence, privacy, intellectual property rights or any other right or is otherwise unlawful or which in our reasonable opinion brings our name into disrepute; or

(ii) do or cause to be done anything which intentionally causes damage or disruption to the Site or which damages, or may damage, our reputation.

LIABILITY

Our liability for matters in relation to which liability by law cannot be excluded or limited shall not be excluded or limited and the rest of these terms and conditions shall be subject to this provision. We provide our services ‘as is’ and we make no warranties or representations or guarantee of any particular outcome, performance or improvement in your mental health or wellbeing. We do not accept any liability for:

(a) the information on this website,

(b) the advice we give or for any consequences of following or not following it, or

(c) in relation to the service we provide or

(d) for any deemed failure to provide our service. We will try to keep our website operational at all times but we do not guarantee its availability or correct functioning at any given time.

Delay, error, loss of data or failure of data transmission between you and us, or non-availability or other problems with the website, will not create any liability on our part. We do not guarantee that our website or content are virus-free or free of other harmful components. We will not be liable for any indirect, special, exemplary, consequential, incidental or punitive loss or damage whatsoever, even if advised of the possibility of such loss or damage. Any external links to third-party websites on the website are provided as a convenience to you. These sites are not controlled by us and we are not responsible for the accuracy, completeness, legality or any other aspect of these other sites including any content provided on them. You access such websites at your own risk.

CONFIDENTIALITY

We will keep your communications to us strictly confidential. However, we may break confidentiality in the event of expressions of self-harm, suspected self-harm, suspected harm to others, or suspected criminal act. COPYRIGHT

This website and all its content, and any communication in any form that we send you (a) are our property or used under licence and you may not copy, resend, redistribute or publish all or any part of them without our permission, and (b) may be viewed, used, downloaded and stored by you for your personal use, but you may not use all or any part of it for commercial purposes.

GENERAL

If any provision in these terms and conditions is deemed to be illegal, unenforceable or invalid for any reason, it shall be deemed to have been struck out and the remaining provisions shall survive and continue to be binding and enforceable. We are a limited liability company based in the United Kingdom and this contract and our services will be subject to English law. Any dispute or question in connection with them will be subject to the exclusive jurisdiction of the Courts of England and Wales.
